Overview

This website, averielle.ca (the "Site"), is operated by AYATA E-Commerce Corporation, doing business as Averielle ("Averielle", "we", "us", "our"). By visiting the Site or purchasing from us, you agree to these Terms of Service ("Terms"), including our Privacy Policy, Shipping Policy and Refund Policy, which are incorporated by reference. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least the age of majority in your province or territory of residence to purchase from the Site. By placing an order you confirm that you meet this requirement and that the information you provide is accurate and complete.

2. Products and descriptions

We make every effort to display our products, including colours, sizes and ingredients, as accurately as possible, but we cannot guarantee that your screen will show them exactly. Product packaging and formulations may change from time to time at the manufacturer's discretion; the information on the product you receive prevails. Always read the label and patch-test new skincare products. Nothing on the Site is medical advice.

3. Pricing and availability

All prices are in Canadian dollars and exclude applicable taxes and shipping unless stated otherwise. We reserve the right to change prices, discontinue products and limit quantities at any time without notice. In the event of an obvious pricing error, we may cancel the affected order and refund you in full.

4. Orders and payment

An order confirmation email means we have received your order, not that we have accepted it. We reserve the right to refuse or cancel any order, including where we suspect fraud, resale, or breach of these Terms. Payment is processed securely through Shopify Payments and its partners; we do not store your full card details.

5. Shipping, returns and refunds

Shipping, delivery, returns, exchanges and refunds are governed by our Shipping Policy and Refund Policy.

6. Promotions and discount codes

Promotional offers and discount codes are subject to the conditions stated at the time of the offer, cannot be combined unless stated, have no cash value and may be withdrawn at any time. First-order welcome discounts are limited to one per customer and household.

7. Accounts

You are responsible for maintaining the confidentiality of your account and for all activity under it. Please notify us immediately of any unauthorized use.

8. Intellectual property

The Averielle name, logo, Site design and all original content are owned by AYATA E-Commerce Corporation. Third-party brand names and product images belong to their respective owners and are used for identification purposes only. You may not reproduce, distribute or exploit any content from the Site without our written permission.

9. Acceptable use

You agree not to use the Site for any unlawful purpose, to interfere with its operation, to scrape or harvest data, to submit false information, or to infringe the rights of others.

10. Third-party links

The Site may contain links to third-party websites. We are not responsible for their content, accuracy or practices, and your use of them is at your own risk.

11. Disclaimer of warranties

To the fullest extent permitted by law, the Site and all products are provided "as is" and "as available" without warranties of any kind, express or implied, except for the manufacturer's warranties that accompany certain products and any warranties that cannot be excluded under applicable consumer protection law, including the Ontario Consumer Protection Act, 2002.

12. Limitation of liability

To the fullest extent permitted by law, Averielle and its directors, employees and suppliers will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site or products. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim. Nothing in these Terms limits rights that cannot be limited under applicable law.

13. Indemnification

You agree to indemnify and hold harmless Averielle from any claim or demand arising from your breach of these Terms or your violation of any law or third-party right.

14. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute will be resolved in the courts of Ontario, subject to any mandatory consumer protection rules in your province.

15. Changes to these Terms

We may update these Terms at any time by posting the revised version on this page with a new "Last updated" date. Continued use of the Site after changes constitutes acceptance.
